In response to your request, the first step we recommend to secure exclusive use of a trade or service mark is a search in the United States Trademark Office to determine whether the trademark is presently registered. Our staff performs this search.

To obtain a search of your service or product mark, provide us with a sketch or sample showing your mark. Describe the first use of the mark and date, if any, and identify the goods and/or services it is used with. Mail the description to us by Certified Mail Return Receipt Requested.

We will forward our report, including the nearest trademarks which have been found during a search, within 1 to 4 weeks. On request, the report is followed by a letter opinion from our corporate trademark counsel stating what further steps are taken to protect a mark. For a search report which discloses that a mark is federally registerable, steps are outlined in the letter which will enable you to obtain "Registration Pending" status for the mark.

A federal only trademark search report costs $195.00, and a full search of federal, state and common-law registrations is $395.00 and includes a written legal opinion at no extra charge. Payment by major credit card is accepted.
